TERMS AND CONDITIONS :

Opting out of our full program eliminates eligibility for free service calls and guaranteed grub control.

1.        Pesticide applications: If applicable, the property owner or owner’s agent may request the specific date or dates of the application (s) to be provided and, if so requested, the pesticide applicator or business must inform of the specific dates and include that date or dates in the contract. 

2.        Underground: Notify Broccolo if you have a Sprinkler System or Underground pet containment fencing. Please note these must be flagged before we perform digging or aeration services. We are not responsible for damage to these items if not properly marked.

4.        About us: Broccolo trains our technicians to care for our environment and use chemicals on an as needed basis. We don’t practice blanket treatment or calendar spraying of any herbicides or pesticides. Best practices include leaving a 12” buffer from planting beds and 24” from vegetable gardens. We want to protect beneficial insects and organisms within our soil. You will receive correspondence via email after each visit regarding what was applied, instruction on watering, personalized notes about your lawn with recommendations from your technician. If issues arise and you request a service call, we can provide at no additional charge for those on our full program. We do not provide grub or insect treatment for those not on a full program.

5.        Automatic Renewal for Broccolo Lawn care Service: This Agreement is for a term of one year and is subject to renew one year term unless Customer gives written notices of cancellation at least 30 days prior to renewal. Broccolo reserves the right to increase the contract sum on a yearly basis due to increased cost of labor and materials.

*Prepay discount does not apply to landscape services. Contractor may assign this Agreement, without Client’s consent, to any purchaser of Contractor’s business or to any successor entity. Upon such assignment, all rights and obligations under this Agreement shall automatically transfer to the assignee. Client may not assign this Agreement without Contractor’s prior written consent.

6.        Changes.  Owner may make changes in the specifications and the Contract Sum shall be adjusted accordingly, provided however, that Broccolo shall not be required to perform any work unless Owner and Contractor agree on the cost increase or decrease in advance

7.        Insurance: Broccolo and all of their partners carries liability insurance for its vehicles and employees. All Broccolo employees are covered by Worker’s Compensation Insurance meeting the requirements of New York State Law.

8.        General Terms: This agreement is entered into in New York State and shall be interpreted under its laws. It may not be altered, changed or modified except by a written document signed by both parties. In the event Customer has a balance owing for more than thirty (30) days, Customer agrees to pay interest thereon at the rate of 1.5% per month until paid. In the event collection is referred to an attorney, Customer agrees to pay Broccolo’s reasonable attorney’s fees.

9.        Payment Terms: after services are billed, payment is required within 30 days.

10.     Seeding: Seeding your lawn is a partnership between Broccolo and you. The most important thing to ensure the success of your seeding is the aftercare. Broccolo seeding services are not guaranteed due to environmental conditions out of our control. If return services are needed for any lack of results or germination, there will be a separate fee. We want you to have the best results possible, and will provide you with proper care and watering instructions. Fall is the best time for seeding. Success of seeding services are dependent on weather and proper care.
